1. Agreement to Terms

By accessing or using Sick Taste (sicktaste.com) (“the Platform,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use the Platform.

2. What Sick Taste Does

Sick Taste provides creator growth and music discovery tools, including but not limited to email-gated download pages, smart links, submission boxes, charts and promotional landing pages. Creators use Sick Taste to distribute content to their audience in exchange for actions such as providing an email address.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating an account, and to update this information as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Creator Content & File Hosting

Sick Taste is primarily a tools platform — not a file hosting service.

Creators are encouraged to host their files on third-party services (such as Dropbox, Google Drive, or similar) and link to them through Sick Taste. In these cases, Sick Taste does not store, control, or take responsibility for the hosted files. The creator is solely responsible for ensuring they have all necessary rights to distribute the content they link to.

Where a creator does upload a file directly to Sick Taste, we perform reasonable checks for potential copyright infringement. However, creators remain fully responsible for ensuring that any content they upload or link through the Platform does not infringe on any third-party intellectual property rights.

5. Prohibited Uses

You agree not to use the Platform to:

• Upload, link to, or distribute content that infringes on the intellectual property rights of any third party.
• Distribute malware, viruses, or any other harmful software.
• Engage in spam, phishing, or deceptive practices of any kind.
• Collect personal data from other users without their consent.
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to interfere with, compromise, or disrupt the Platform or its infrastructure.
• Impersonate another person or entity, or misrepresent your affiliation with a person or entity.
• Artificially inflate chart positions, download counts, follows, or any other Platform metric, whether by automated means or otherwise.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

6. Intellectual Property

All rights, title, and interest in and to the Platform — including its design, code, branding, logos, and documentation — are owned by Sick Taste. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

Creators retain ownership of the content they create, upload, or link through the Platform. By using Sick Taste, creators grant us a limited, non-exclusive licence to display, distribute, and facilitate access to their content solely for the purpose of operating the Platform and providing its services.

7. Charts, Rankings & Featured Placement

Chart positions, trending and featured placements are determined at our discretion, using a combination of Platform activity and editorial judgement. We make no guarantee of placement, visibility, or ranking, and we may adjust, recalculate, or remove any listing at any time — including where we believe activity has been artificially inflated.

8. Third-Party Services

Sick Taste may integrate with or link to third-party services (e.g., file hosting providers, email services, analytics tools, streaming platforms). We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed by their respective terms and policies.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using Sick Taste, you consent to the collection and use of information as described in that policy.

10. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We make no representations or warranties regarding the accuracy, reliability, or completeness of any content made available through the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, Sick Taste and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the Platform — regardless of the theory of liability.

Our total aggregate liability for any claims arising from your use of the Platform shall not exceed the amount you have paid to Sick Taste in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of England and Wales.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sick Taste and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the “Last Updated” date above. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, indemnification, and dispute resolution) will continue to apply.

15. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in the UK or EU, nothing in this section removes any protection you have under the mandatory law of the country where you live.
